FamilyNest — Terms of Service

These terms govern your use of the FamilyNest app, published by CJ Designs Ltd ("we"). By using FamilyNest you accept them.
Using FamilyNest
You must be 13 or older to hold an account. Children younger than that can appear in a household as managed profiles created and controlled by an adult; they do not have accounts and do not use the app themselves.
You are responsible for what you put into the app and for keeping your password to yourself. Tell us promptly if you think someone else has access to your account.
Households and shared content
FamilyNest is a shared product. Anything you mark as visible to your household is visible to the adults and teenagers in it, and will remain in that household's calendar even if you later leave or delete your account. This is deliberate — a shared calendar that emptied when one person left would not work.
Events you mark as private are visible only to you.
A household owner can remove members and delete the household. If you own a household you cannot delete your account until you have handed it to another adult or deleted it.
Acceptable use
Do not use FamilyNest to break the law, to harass anyone, to store or share material you have no right to, or to attempt to gain access to data that is not yours. Do not attempt to disrupt the service or circumvent its access controls.
We may suspend or terminate an account that does these things.
Availability
FamilyNest is provided as it is. We do not guarantee that it will be available without interruption or free of faults, and we do not guarantee that a reminder will be delivered.
Reminders are scheduled on your own device, not sent from a server. A reminder set on one device will not appear on another, and a device that is switched off will not receive it later. Do not rely on FamilyNest as the only reminder for anything critical, such as medication or a medical appointment.
Your data
How we handle your data is described in our Privacy Policy, which forms part of these terms.
You keep ownership of everything you put into FamilyNest. You grant us only the permission needed to store it and show it to the people you have chosen.
You are responsible for keeping your own copies of anything you cannot afford to lose. We take backups, but we do not guarantee recovery of individual items.
Price
Version 1.0 is free to use. If we introduce paid features later we will make clear what is included before you are asked to pay, and existing free features will not be taken away from you without notice.
Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Otherwise, and to the extent the law allows, we are not liable for indirect or consequential loss, for loss of profit or opportunity, or for any consequence of a missed reminder or a calendar entry that did not synchronise. Our total liability is limited to the amount you have paid us for FamilyNest in the previous twelve months.
These terms do not affect your statutory rights as a consumer.
Ending it
You may stop using FamilyNest at any time and delete your account from within the app. We may end your access if you seriously or repeatedly breach these terms.
Changes
We may update these terms. If a change materially affects you we will say so in the app before it takes effect. Continuing to use FamilyNest after that means you accept the change.
Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
